Dailey ’87, a dean and professor at the University of Connecticut School of Law, and Erika Bachiochi, a fellow at the Ethics and Public Policy Center, delivered responses. </video> <video> Ames Moot Court Competition 2024 Description: On November 19, 2024, the Ames Moot Court Competition Final Round took place in Ames Courtroom at Harvard Law School. This year, the esteemed panel of judges featured Ketanji Brown Jackson ’96, associate justice of the United States Supreme Court; Patti B. Saris ’76, a former chief judge of the United States District Court for the District of Massachusetts and lecturer on law at Harvard; and Joan L. Larsen, a circuit judge of the United States Court of Appeals for the Sixth Circuit. This year's fictional case was Daniel Welles, Attorney General of the United States v. John Doe: John Doe, an undocumented immigrant residing in Ames City with strong community ties, including family and civic involvement, seeks legal protection to possess a firearm for self-defense due to neighborhood safety concerns. 18 U.S.C. § 922(g)(5)(A) prohibits firearm possession by individuals unlawfully present in the United States. Doe challenged this restriction, arguing that it violates his Second Amendment rights. The District Court upheld the federal restriction, referencing prior circuit precedent that excluded undocumented immigrants from Second Amendment protections. The Court of Appeals reversed, reevaluating the issue under the Supreme Court’s ruling in New York State Rifle & Pistol Ass’n v. Bruen. The Court of Appeals concluded that Doe has sufficient ties to be part of “the people” under the Second Amendment and found insufficient historical evidence to justify disarming him solely based on his immigration status. The Supreme Court granted certiorari to address two key questions: 1. Whether a noncitizen unlawfully present in the United States but with substantial ties to the country is part of “the people” with Second Amendment rights. 2. Whether the government can disarm noncitizens unlawfully present in the United States but with substantial ties to the country, consistent with the history of the Second Amendment. Baradaran is the Robert Braucher Visiting Professor of Law at HLS and a professor of law at UC Irvine School of Law. The event was part of a regular series of book talks presented by the Harvard Law School Library. </video> <video> HLS Human Rights Program | Accountability, Reconciliation, and Transitional Justice in Sri Lanka Description: On November 13, Harvard Law School's Human Rights Program, Program on Law and Society in the Muslim World, and HLS Advocates for Human Rights hosted an event titled "Accountability, Reconciliation, and Transitional Justice in Sri Lanka: Role of the International Community," a discussion between panelists Kate Cronin-Furman and Thyagi Ruwanpathirana on the Sri Lankan civil war and the search for remedy of harms suffered by Sri Lankans during those years of conflict. Victims of Sri Lanka’s internal armed conflict have been seeking truth, justice and reparations for the abuses and violations of international law committed during the nearly three-decade long war. Domestic transitional justice efforts have been largely piecemeal, with no real political will to address longstanding grievances. In addition to the change of government and their commitments to operationalize a new Truth and Reconciliation Commission victims are largely skeptical of, the panel discussed the role of the international community to ensure that Sri Lanka’s victims of grave human rights violations and abuses find redress. Panelists: Kate Cronin-Furman studies mass atrocities. She is an associate professor in the Department of Political Science at University College London, where she directs the MA in Human Rights. Cronin-Furman received her Ph.D. in political science from Columbia in October 2015 and has held fellowships at the Harvard Kennedy School’s Belfer Center for Science and International Affairs and Stanford’s Center for International Security and Cooperation. In addition, she has a J.D. and has practiced law in New York, Cambodia, and The Hague. Thyagi Ruwanpathirana is the 2024 Neelan Tiruchelvam Memorial Fellow, hosted jointly by the Human Rights Program and the Program on Law and Society in the Muslim World at Harvard Law School. As the Tiruchelvam Fellow, her research project focuses on the creation of an enabling environment for a post-conflict Truth Commission that meets the needs of the victims of Sri Lanka’s internal armed conflict. Thyagi works as Amnesty International’s South Asia Regional Office in Colombo, Sri Lanka since 2018. After having completed her Bachelor of Laws (LLB) from the University of Warwick, UK in 2010, Thyagi obtained her Master of Law (LLM) in Human Rights in 2011 from Birkbeck College, University of London. Pozen was joined by Mason Marks and Jeannie Suk Gersen ’02 to discuss the lost history of constitutional challenges to punitive drug laws and consider possible future paths open to drug reformers today. Pozen is the Charles Keller Beekman Professor of Law at Columbia University, where he teaches and writes about constitutional law, information law, and nonprofit law among other topics. Discussant Jeannie Suk Gersen is the John H. Watson, Jr. Professor of Law at Harvard, where she has taught constitutional law, criminal law and procedure, family law, and the law of art, fashion, and the performing arts.
