The Transgender Person Protection of Rights Bill 2016 has its own essence and highlights that give recognition to the third gender community of our country. In this bill, the definition of a transgender person has been defined as a person who is partly male or female, a combination of both male or female, or neither a male or female. The gender of the transgender person must not match with the gender at birth, which includes trans men or trans women, intersex variations, and genderqueer. Key provisions of this bill are as follows: Firstly, it provides a certificate of identity to the transgender person. Under this, the bill protects one's self-assertive gender identity for the transgender persons in our country. In order to obtain the certificate of identity, one has to apply to the district magistrate, who will forward it to the district training committee. The district training committee will comprise of a social welfare worker, a transgender representative, a medical official, and several government officials, including a psychologist, and so on. They will be considering the case for the above matter. The second point deals with the prohibition of discrimination. Under the prohibition of discrimination, the bill prohibits discrimination against the transgender person based on unfair discrimination, denial of services, healthcare, immigration, education, employment and access to public service and public goods. Thirdly, the provision of imprisonment. The bill ensures provision of imprisonment of offences whereby the transgender persons are begged to do or forced to do wanted labours, excluding compulsory government service, along with cases where they are denied access to public services or public places, access to households in villages or residential complexes. Lastly, if there is any form of sexual, verbal, or physical abuse that has been conducted. For all these offences, there will be strict imprisonment that will be attracted between six months to two years. Therefore, we can finally conclude that this bill, that is the Transgender Person Prohibition of Rights Bill 2016, has provided us with various rules, schemes, regulations that has been helpful in safeguarding the rights and identification of the transgender community in our country. #transgender #transgenderrights #protection </video> <video> The POCSO Act ft. This decision comes after nine final-year law students, led by Nilay Rai, challenged the Bar Council of India’s notification barring them from registering. The students argued that delays in university exam results could unfairly cause them to miss the AIBE, delaying their entry into the legal profession by an entire year. The Court referred to a 2023 decision in Bar Council of India v. Bonnie Foi Law College, which suggested that students eligible for their final semester should be allowed to take the AIBE, provided their results remain valid only if they pass their final exams. The Court emphasized that this interim order was crucial to avoid leaving students ‘in the lurch’ due to delays in university processes. Now, all eligible final-year students can apply for the AIBE, with the last date to register being October 25, 2024. However, their AIBE results will only be valid once they successfully clear all components of their law degree. This timely intervention ensures that law students across the country won’t lose a chance to sit for the AIBE on December 22, 2024, securing their path toward legal practice. However, the Apex Court disposed of the matter by liberty to approach competent authority, citing procedural and legal impediments. The Court noted the non-inclusion of the Election Commission of India (ECI) as a respondent and apso referred to a precedent set by the Kerala High Court, which held that political parties are not bound by the POSH Act.
