After nearly dying from a ruptured stomach, Lynn, Massachusetts resident Gene Runkis’ car was stolen. After recovering from a coma at Brigham Salem Massachusetts General Hospital, and being bedridden for nearly a month, Mr. Runkis attempted to file a stolen car police report on Jan. 4, 2024 at approximately 7:15 p.m. The officer who appears on this video would only identify herself with a presumably false badge number of “101,” but is referred to by other officers as "Coach." She mumbled her name which she refused to repeat. She wore her badge in a way that concealed her identity. Although Mr. Runkis provided a written sworn notarized statement of the facts of the case and his hospital records, the unnamed Lynn police officer both on this video and separately in the presence of Mr. Runkis’ Attorney-in-Fact the following reasons for her refusal to take a stolen car report: 1). Although he was hospitalized and incapacitated, Mr. Runkis waited too long to file a stolen vehicle report. 2). The car had been towed, which the officer stated, means that it could not have been stolen. 3). The car was not insured and not registered, which disqualified Mr. Runkis from reporting the car as stolen. The car is in fact owned by Mr. Runkis whose name appears as the sole registered owner. 4). The officer refused to read the medical reference information that establishes the facts of Mr. Runkis’ incapacity and disability. 5). The officer stated on this video, which was recorded with her permission, that Mr. Runkis was only filing the police report to attempt to commit insurance fraud, although he has no record of ever having done so, and with no explanation as to how she came to that conclusion. Most remarkably, by the officer’s own statement, Mr. Runkis’ insurance had lapsed two months prior, making even filing an insurance claim impossible. 6). Mr. Runkis and his disability advocate and Attorney-in-Fact requested of officer "Coach" the location where the vehicle was recovered from. She refused, and said that the City of Lynn Public Records Department would provide him the information. 7). The following morning, Mr. Runkis filed a public records request. Although the officer refused to file a stolen car report, Mr Runkis' public records request #24-66 was denied, with the reason cited in the email from the City of Lynn, MA as being: "An ongoing investigation Record request #24-66 has been closed. Your records request is denied. The records you requested are exempt from disclosure. Please note that certain records or portions thereof are exempt from disclosure under the public records law and those records will be withheld: Materials pertaining to on-going investigations or prosecutions (G.L. c. 4, § 7(26)(f)); Criminal Offender Record Information (“CORI”) (G.L. c. 4, § 7(26)(a); G.L. c. 6, §§167A, 172); reports of rape, sexual assault, or domestic violence (G.L. c. 4, § 7(26)(a); G.L. c. 41, § 97D); and personnel files (G.L. c. 4, § 7 (26)(c))." Mr. Runkis' public records request, however, only asked for the time, date and location the car was recovered and towed from.
